General Terms and Conditions

1. General

These General Terms and Conditions are valid for all events held by Thomas Prückler. They will become part of the contract, independent of whether the order was passed personally, by mail, by telephone or online.

1.1 Thomas Prückler reserves the right to amend these General Terms and Conditions and these amendments will come into force as soon as they have been published on the internet. In the case of online orders the General Terms and Conditions will become part of the order contract as soon as the customer clicks on the checkbox "I have read and accepted the General Terms and Conditions".

1.2 The General Terms and Conditions are applicable for consumers and entrepreneurs. If individual provisions solely find application for entrepreneurs, this will be indicated respectively.

1.3 Thomas Prückler does not recognize any contradicting or deviating terms and conditions of the customer unless Thomas Prückler has expressly agreed to such other terms and conditions in writing.

1.4 If tickets are ordered, the customer commissions Thomas Prückler with the delivery or keeping available (pickup) of tickets for the selected event.

1.5 The contract between Thomas Prückler and the customer is concluded as follows in the case of online orders: The customer remits the participation fee to Thomas Prückler. In this case the contract is concluded by the sending of the binding participation confirmation by Thomas Prückler. Should Thomas Prückler not want to accept the offer of the customer, Thomas Prückler will inform the customer thereof per e-mail. However, this information is not legally binding.

2. Prices/delivery fees

2.1 The price which is announced on the internet or by telephone or which is indicated, otherwise is binding for the selected order transaction. Incorrectly indicated prices will be pointed out before an order is placed.

2.2 A delivery fee and/or a ticket fee and/or a deposit fee and/or a booking fee can accrue for each order transaction in addition to the stated price. The respective additional fees will be made known during the respective order transaction.

2.3 All prices include the applicable Value Added Tax.

2.4 If special prices for reductions (students, seniors, severely disabled etc.) are granted, this will be listed separately. If no reductions are listed, these may not be granted either. In order to qualify for a reduction the customer has to present an appropriate form of ID (student identification, personal identification as proof of age for seniors and identification as defined in the Ordinance on Passes for Severely Disabled Persons. The ID must be presented at the admission control. If the customer is unable to do so, the difference between the full price and the reduced price has to be paid retroactively at the entrance in order to be allowed admission.

3. Payment

3.1 The payment is to be made as indicated below. If additional fees should accrue from the payment which are collected by Thomas Prückler, these are listed separately. Any prices and fees are due immediately upon the conclusion of the contract.

3.2 Should a payment be redebited (e.g. due to insufficient funds in the account specified when ordering) Thomas Prückler is entitled to an immediate return delivery of the ordered tickets or vouchers. The contractual partner is obliged to compensate for any damages or expenses arising from the return debit to Thomas Prückler. This includes in particular banking fees as well as a processing fee to the amount of 5.00 € per return debit for the processing by Thomas Prückler. In the event of a return debit Thomas Prückler is entitled to withdraw immediately from the contract. The contractual partner will consequently lose his right to participate in the booked event. Further claims of Thomas Prückler against the contractual partner remain unaffected thereof.

4. Withdrawal/cancellation

4.1 If the contractual partner does not want to take part in the event, he has to declare his withdrawal from the contract to Thomas Prückler in writing by sending an e-mail to the e-mail address and by sending the ticket (the invoice) back.

4.2 If the contract is terminated/cancelled at least six weeks before commencement of the event, the seminar fee will be refunded less a processing fee of 40.00 €.

4.3 If the contract is terminated/cancelled after this date, the refund of the seminar fee is not possible. However, this ticket is transferable and a substitute participant can take part in the event upon the presentation of the invoice.

5. Cancellation of the event by Thomas Prückler

5.1 In case of a cancellation of the event Thomas Prückler will repay all the amounts paid. Shipping costs and other additional fees will only be refunded if the cancellation of the event is attributable to intent or gross negligence on the part of Thomas Prückler.

5.2 In the case of a postponement of the event the contractual partner is entitled to withdraw from the contract. Thomas Prückler undertakes to inform the contractual partner at his own discretion under an address stated at the time of booking (by mail, e-mail, telephone etc.) without delay. The sending of such information is regarded as sufficient. Any travelling charges, hotel bookings etc. will only be refunded by Thomas Prückler if the cancellation of the event or the non-information of the contractual partner is attributable to intent or gross negligence.

6. Liability

Every participant is personally responsible for any experiences which are made during and after the event. Thomas Prückler does not assume any liability for any problems or disturbances whatsoever which might occur in connection with the event and is only liable in the case of intent or gross negligence. Events, seminars or individual sessions do not replace a medical treatment.

7. Guarantee

Thomas Prückler does not assume any guarantee for the success of the offered events.

8. Jurisdiction / applicable law

Place of jurisdiction for all disputes is the competent court in 7000 Eisenstadt. The law of the Republic of Austria applies.
